Réaction 🇪🇺 | L’aviation d’affaires réintègre la taxonomie européenne

Le Tribunal de l’Union européenne a jugé que la fabrication de jets privés peut être qualifiée d’investissement comme contribuant substantiellement à l’atténuation du changement climatique ou à l’adaptation à celui-ci.

L’EBAA France salue le jugement du Tribunal qui annule ainsi l’exclusion (rendue par la Commission européenne en 2023) de la fabrication d’avions d’affaires de la taxinomie européenne.

« La Commission a omis de prendre en compte certains facteurs pertinents, notamment la capacité de ces appareils à voler avec des carburants d’aviation durables », explique le Tribunal.L’EBAA a apporté un soutien actif à Dassault Aviation et Daher pour défendre ses membres contre une disposition qui mettait profondément en difficulté l’avenir du secteur. L’association s’est notamment battue pour assurer la prise en compte des caractéristiques du secteur, la reconnaissance des actions de ses membres et la nécessité absolue pour leur avenir d’être intégrés à la taxonomie européenne.

Avec ce jugement, le Tribunal reconnaît que la décision de la Commission ne tenait manifestement pas compte des caractéristiques propres à l’aviation d’affaires et que « les avions d’affaires présentent pour leurs utilisateurs une importante flexibilité quant aux itinéraires et aux plannings de vol » et que l’aviation joue « rôle crucial pour améliorer la cohésion, la connectivité et l’accès au marché intérieur pour toutes les régions de l’Union ».

La CE peut faire appel de cette décision dans un délai de deux mois.

Business Aviation Reinstated in the EU Taxonomy!

The General Court of the EU has ruled that the manufacture of business jets may qualify as an investment that makes a substantial contribution to climate change mitigation or adaptation.

EBAA welcomes the Court’s ruling, which overturns the EC’s 2023 decision to exclude the manufacture of biz aircraft from the EU Taxonomy.

“The Commission failed to take into account certain relevant factors, including the ability of these aircraft to operate using sustainable aviation fuels,” the Court explained.

EBAA actively supported Dassault Aviation and Daher in defending its members against a provision that posed a significant threat to the future of the sector.

With this ruling, the Court acknowledges that the Commission’s decision clearly failed to take into account the specific characteristics of BA. It noted that “business aircraft provide their users with significant flexibility in terms of routes and flight schedules,” and that aviation plays “a crucial role in improving cohesion, connectivity and access to the internal market for all regions of the Union.”

The European Commission may appeal the ruling within two months.
